A Right-of-Way (ROW) or easement is a legally recorded right to use a specific portion of property for a defined public utility purpose. Easements allow access for actives such as streets, sidewalks, drainage, and the installation, maintenance, repair, or replace of utility infrastructure.
Easements may exist on privately owned property and do not transfer ownership of the land. Instead, they grant limited access right for specific uses, established through recorded plats, deeds, or other legal instruments. The City or authorized utility providers may access these area as allowed by law.
Common concerns in ROW areas include, sidewalks, utility access, drainage features, and vegetation that my affect visibility or pedestrian access.
This explanation is consistent with general guidance published by the Texas State Law Library regarding easements under Texas Law: Easements - Neighbor Law - Guides at Texas State Law Library
In residential areas, Right-of-Ways typically extend approximately 10 feet beyond the curb line, though this can vary by location. Some properties may also have additional recorded easements, most commonly utility easements, located beyond the ROW and often along the rear or sides of the property.
Right-of-Ways and easements are typically established during the subdivision and platting process and are recorded with the county. Their location and width can vary depending on the property.
Right-of-Ways and easements are typically established during the subdivision and platting process and are recorded with the county in which the property is located. Property owners may review recorded subdivision plats, easement documents, or deeds through the county clerk’s office, which may be available online. Depending on where the property is located in Schertz, you may have to contact Bexar, Comal or Guadalupe County for these records.
Property owners may also reference their property survey, which is commonly provided at the time of closing, to identify the general location of recorded ROW and easements in relation to property lines.
The City of Schertz maintains records of public Right-of-Way and certain utility easements. For assistants reviewing available information or confirming City-held records, property owners may contact the Planning or Public Works Department.
For general, non-City specific information about ROW and easements, residents may also refer to resources published by the Texas State Law Library: General Information - Neighbor Law - Guides at Texas State Law Library
Flags and paint markings typically indicate the approximate location of the underground utilities. These markings are placed after a Texas811 request is made to help prevent damage during excavation.
Each color represents a different type of utility, such as electric, gas, water, wastewater, or communications. Markings are temporary and may fade or be removed once work is completed.
For more information about utility color codes, visit Underground Utility Color Code - Texas 811.
Information about active or upcoming work in Right-of-Ways (ROWs) and easements may be available through the City of Schertz’s Capital Improvement Program (CIP) Dashboard or the What’s Developing in Schertz page.
For permitted projects, contactors or utility providers are required to provide advance notice to affected residents and property owners within the immediate work area, such as through door hangers, posted notices, or on-site signage. The timing and method of notification may vary depending on the nature and scope of the work.
For questions related to ROW permits or specific work locations, property owners may also contact the City of Schertz Public Works Department at 210-619-1800.
Property owners are generally responsible for keeping areas adjacent to their property safe and clear for public use. This includes maintaining private landscaping and vegetation in a way that does not obstruct sidewalks, visibility, or access within the Right-of-Way.
Common responsibilities may include:
- Trimming trees or shrubs that block sidewalks or reduce safe pedestrian access (at least 15ft of vertical clearance above the sidewalk.)
- Trimming vegetation near streets and alleys to prevent obstruction (at least 14ft of vertical clearance above streets and alleys.)
- Keeping intersection and corners visible (vegetation should not block sightlines for drivers, cyclists, or pedestrians.)
- Keep fire hydrants and utility access points clear.
- Avoiding placement of personal items (vehicles, trash carts, landscaping material, etc.) in a way that blocks sidewalks, streets, or ROW access.
If an underground utility line or facility is damaged during excavation, the damage must be reported immediately to Texas 811 and the Utility owner.
Only the utility operator, or party authorized by the utility operator, may perform or approve repairs. Excavation or backfilling in the affected area may be paused until the damage is assessed and appropriate corrective action is taken.
The person or company preforming the excavation is responsible for complying with Texas 811 requirements and for reporting any damage. When a homeowner hires a contractor, the contractor is generally responsible for excavation activities. If a homeowner performs excavation themselves, they assume that responsibility.
Failure to follow Texas 811 requirements may result in repair responsibility and/or other actions allowed by state law.
If damage occurs as a result of work performed within a Right-of-Way (ROW) or easement, the company performing the work is responsible for addressing the damage and restoring the affected area in accordance with City standards and applicable permit requirements.
City ordinances require the property affected by authorized ROW or easement work be restored to a condition that is equal to or better than its condition prior to construction, as determined by the City and subject to approved restoration methods.
Property owners should first contact the company performing the work using the contact information provided on posted notices, door hangers, or on-site signage. If the issue is not resolved, property owner may contact the City of Schertz Public Works Department for assistance in coordinating restoration requirements.
For additional information regarding restoration requirements, please refer to the City of Schertz Code of Ordinances, Sec. 78-127- Restoration of Property (https://library.municode.com/tx/schertz/codes/code_of_ordinances? nodeId=PTIICOOR_CH78STSI_ARTVRI-WCO_S78-127REPR)
Texas 811 is a notification and communication service that coordinates utility marking requests; it is not an enforcement agency.
Compliance with the Texas One-Call Law is established under Texas Utility Code, Chapter 251, which sets requirements for excavation notification, utility marking, damage reporting, and coordination between excavators and utility operators.
Compliance with Chapter 251 is governed by state law. Responsibilities related to excavation practices, damage response, and corrective actions are addressed through applicable state statues, utility provider requirements, and, where applicable, local ordinances are permit conditions.
Work occurring within City right-of-way may also be subject to City review and oversight in accordance with adopted ordinances and permit requirements.
In many cases, property owners are responsible for maintaining vegetation adjacent to property, including trimming overgrown trees or shrubs that block sidewalks, street signs, or visibility for drivers and pedestrians.
However, responsibility may vary depending on whether the vegetation is located on private property, within a public Right-of-Way, or within an easement. For question about Right-of-Way vegetation concerns or safety issues, residents may contact the City of Schertz Public Works Department for guidance.
Keeping sidewalks and visibility area clear helps support pedestrian safety, accessibility, and safe traffic flow.
